Application Procedure for Philippine Approved Exporters under PH-EFTA FTA

Approved Exporters
Those applying as Approved Exporters who are not manufacturers or producers must have knowledge on how the goods were manufactured or produced and how these satisfy the ROO requirements to make an Origin Declaration under the PH-EFTA FTA.
7 Working Days
Exporters shall be notified about the result of evaluation. Approved Exporters shall be assigned with a Customs Authorization Number within seven (7) working days after receipt of the complete set of documents by ECD.

Application Procedure for Approved Exporter Status under RCEP Agreement

1 An exporter which intends to be an Approved Exporter shall submit the following documentary requirements to the BOC through the AOCG Deputy Commissioner
  • A Duly accomplished application form (Annex 2)
  • B BOC’s Certificate of Registration
  • C PER(Product Evaluation Report) (if applicable)
  • D In the case of a trader, a producer’s declaration indicating the originating status of the good for which it will complete a DO and the readiness of the producer to cooperate in verification procedures in accordance with Article 3.24 ( Verification) of the RCEP Agreement and Section 6 of this order
  • E List of Authorized signatories and their respective specimen signatures
2 The application shall be submitted both in hard copy and an electronic PDF file to the AOCG Deputy Commissioner through the Customer Care Center.
3 The ECD shall evaluate the application based on the following criteria:
  • A Exporter is a legitimate exporter, who must have been transacting with the BOC for at least one (1) year prior to the date of application
  • B Exporter must have been exporting products to at least one (1) RCEP Party for at least one (1) year
  • C Exporter must have a good compliance, measured by risk management of the BOC
  • D Exporter must have a sound bookkeeping and record keeping system
  • E Exporter must have responsible officer/s or person/s authorized to sign the Declaration of Origin (DO), who must have sufficient knowledge, competence in Rules of Origin (ROO) application
  • F Exporter must be willing to undergo regular monitoring and inspection to determine the correctness of its declaration with respect to the goods exported

ECD : 14 working days
After evaluation, if the application is found to be meritorious, the ECD shall grant the Approved Exporter status through the issuance of a written authorization with the corresponding authorization code within fourteen (14) working days from the date of receipt of complete application. If not, it shall issue a letter of disapproval stating the reason/s for the denial
5 As endorsed by the ECD, wither the written authorization or letter ofdisapproval shall be duly signed by the AOCG Deputy Commissioner.
6 Immediately after the grant of Approved Exporter status, the ECD shall promptly include the following details on the Approved Exporter database:

Legal name and address of the Approved Exporter

Authorization code

Issuance date and, if applicable, the expiry date of the authorization code

List of goods subject to the authorization, including product description HS in six digit or AHTN Code/s

List of authorized signatories and their respective specimen signatures

Any changes on subparagraphs under item number 6 shall be promptly included in the approved Exporter database by the ECD in the same manner. Withdrawal or suspension of the authorizations shall also be included in the same manner by the ECD.

Obligation of Approved Exporter Status under RCEP Agreement

The following are the obligations of an Approved Exporter:

Allow the BOC to access records and premises for the purposes of monitoring the use of authorization and the verification of the accuracy of the declarations made.

Complete DO only for goods for which the Approved Exporter has been allowed to do so by the BOC and for which it has all appropriate documents proving the originating status of the goods concerned at the time of completing the declaration.

Take full responsibility for all DO completed, including any misuse

Promptly inform BOC of any changes related to the following information
i. Legal name and address of the Approved Exporter
ii. List of goods subject to the authorization , including product description HS in six-digit or AHTN codes
iii. List of authorized signatories and their respective specimen signatures

Cooperate in verification procedures

An Approved Exporter must keep a copy of the DO and all documents supporting the originating status of the good, in paper or in electronic form, for at least three (3) years from the date of its completion.

Application Procedure as "Registered Exporter" in REX System

STEP 1

Producers, manufacturers, or traders may apply to be a “Registered Exporter” by filling out the application at https://customs.ec.europa.eu/rex-pa-ui/#/create-preapplication/.

Those applying as Registered Exporters who are not manufacturers or producers ( for instance, traders) must have knowledge on how the goods were manufactured or produced, for instance, he should have in his possession all necessary documents i.e. supplier’s declaration allowing him to declare and prove the origin of the goods.

STEP 2

Once the application has been filled-out and submitted electronically, this shall be printed and submitted to the concerned Export Division/Unit together with the following documents:

Unique Reference Number (URN) as PEZA Locators, Client Profile Registration System (CPRS) for non-PEZA Locators or other equivalent document;

Product Evaluation Report (PER), if applicable.
STEP 3

Applications evaluated by concerned Export Division/Unit of the port shall be endorsed to ECD for its registration to the REX System. Registered Exporters shall be assigned with a REX Number within seven (7) working days from receipt of the complete set of documents endorsed by the port to ECD.

ECD shall notify the Exporters and the endorsing port on the result of the application with the assigned REX Number. Denial of application shall be communicated stating the reasons therein.

Application Procedure for Philippine Certified/Approved Exporters under ASEAN Wide Self-Certification Scheme (AWSC)

1 An exporter which intends to be a Certified Exporter shall submit the following documentary requirements to the Bureau of Customs (BOC)
  • Duly accomplished application form
  • Unique Reference Number as Philippine Economic Zone Authority (PEZA) locators and Client Profile Registration System for non-PEZA locators or other Free Zone Locators
  • List of Official/s and their positions in the company authorized to sign the Origin Declaration with their respective specimen signatures (not to exceed 10 persons)
  • Evaluation report for goods applied for authorization to make out an Origin Declaration
  • In case of a trader, a "manufacturer's declaration“ indicating the origin of the product for which it will make out Origin Declarations and readiness of the manufacturer to cooperate in retroactive check and verification visit should the need arise.
2 The application shall be submitted both in hard copy and in electronic Portable Document Format (PDF) to the AOCG Deputy Commissioner through the Bureau’s Customer Care Center (CCC).

3 The hard copies of the application and supporting documents must be placed in the long brown envelope properly labeled using size 16 Arial font with the following details, all in capital letters:

In case of electronic copies, the same may be submitted online or through Flash Drive (USB). Only PDF file type shall be submitted as a separate file. The resolution of the electronic documents shall be at least 600dpi. The file name format shall be as follows:

The same template shall be applied in case there are other documents to be submitted.

4 The ECD shall evaluate the application based on the following criteria:

After evaluation, if the application is found to be meritorious, the ECD shall recommend to the Deputy Commissioner, AOCG the granting of Certified Exporter Status and prepare the written authorization with the corresponding authorization code within fifteen (15) working days from the date of receipt of complete application. If not, it shall issue a letter of disapproval stating the reason/s for the denial

Issuance date and, if applicable, the expiry date of the Certified Exporter authorization number

List of goods subject to the authorization, including product description HS in six digit or AHTN Code/s

List of authorized signatories and their respective specimen signatures

Any changes on subparagraphs under item number 7 shall be promptly included in the ASEAN AWSC database by the ECD in the same manner. Withdrawal or suspension of the authorizations shall also be included in the same manner by the ECD.

The ECD shall include all Philippine Certified Exporters to the Philippine AWSC database for at least 3 years from the date of granting the Certified Exporter status.
